By visiting our Site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms"), including any additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the Site, including, without limitation browsers, vendors, customers, merchants, and content contributors. These Terms apply to all current and future sales.

Please read these Terms carefully before accessing or using our Website. By accessing or using any part of the Site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, you may not access the Website or use any services. If these Terms are considered an offer, acceptance is expressly limited to these Terms.

Placing an order constitutes a binding agreement. A confirmation will be sent to the email address provided during the ordering process.

By submitting your order, you expressly agree that we may conduct a credit check with authorised credit institutions and agencies. We reserve the right to refuse any order in the event of a negative credit report.

The use of electronic communications, such as email, constitutes a valid agreement. We may rely on electronic logs to establish the existence of such an agreement.

Any breach of these Terms will result in immediate termination of the agreement.

We reserve the right to refuse service or the fulfilment of any Product order to anyone, for legitimate and reasonable grounds, at any time.

We reserve the right to reject an order if we reasonably believe that you are acting in breach of these Terms, engaging in fraudulent activity, or involved in any criminally relevant conduct.

You understand that your content (excluding credit card information) may be transferred unencrypted and may involve: (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices.

Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Product, use of the Product, or access to the Product or any contact on the Website, without express written permission from us.

SECTION 5 – AVAILABILITY OF THE PRODUCT

Products displayed on the Website are available while stocks last. We reserve the right to change or discontinue Products at any time without prior notice and to limit the quantity of items purchased per customer.

We are not liable for the unavailability of any item. If an item is unavailable, it may be reserved by placing a preorder. Pre-ordered jewellery is typically produced and shipped within six to eight (6-8) weeks.

Commercial resale or redistribution of Products is strictly prohibited unless expressly agreed in writing by Thésaurí.

SECTION 6 – PRICES

Product prices are listed in EUR.

European Union: Orders are treated as local shipping; no additional taxes or customs duties apply.
United Kingdom & United States of America: Orders are shipped under DDP (Delivered Duties Paid) terms. All applicable import duties and taxes are prepaid by the Company and included in the product price.
Other Regions: Orders are shipped under DAP (Delivered At Place) terms. The recipient is responsible for any applicable import duties and taxes imposed by local customs authorities.

We reserve the right to change prices at any time; however, the price confirmed at checkout will be honoured for that transaction. We also reserve the right to correct any obvious pricing errors after the sale is concluded. In such cases, we will notify you within five (5) working days.

SECTION 7 – PAYMENT

All costs associated with your chosen payment method shall be borne by you.

We accept the following methods of payment:

All payments are processed through secure payment systems. If the payment is not received within seven (7) calendar days of order confirmation, we reserve the right to cancel your order. Ownership of all Products remains with us until payment is received in full.

We reserve the right to modify or discontinue any Product (or part thereof) at any time without notice.

We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuation of a Product.

SECTION 9 – PRODUCTS OR SERVICES

Certain Products may be available exclusively online through the Website. These items may be available in limited quantities and are subject to return or exchange only in accordance with our 30-day return policy.

To request a cancellation of your order, please email us at jewellery@thesauri.eu. We will review your request promptly; however, if your order has already been shipped at the time of your contact, you may still return the item following our return procedure. In such cases, please note that you will be responsible for the cost of the return shipping label.

We make every effort to display the Products and their colours as accurately as possible. However, we cannot guarantee that your computer monitor's display of any colour will be accurate.

We reserve the right, though we are under no obligation, to restrict the sale of our Products to any person, geographic region or jurisdiction. This may be exercised on a case-by-case basis. We reserve the right to limit the quantities of any Products offered. All Product descriptions and pricing are subject to change at any time without prior notice. We may discontinue any Product at any time. Any offer for a Product on this Website is void where prohibited.

We do not warrant that the quality of any Products, services, or other materials purchased or obtained by you will meet your expectations.

SECTION 10 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

In the event of a change to or cancellation of your order, we may notify you using the email address, billing address or phone number provided at the time of the order.

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all transactions made at our store.

You agree to promptly update your account and other details, including your email address, credit card numbers and expiry dates, to ensure that we can complete your transactions and contact you as necessary.

We do not guarantee that your use of the Website will be uninterrupted, timely, secure or error-free. From time to time, we may remove Products or suspend access to the Website for indefinite periods, without notice. You expressly agree that your use of, or inability to use, the Website or Product is at your sole risk.

Except as expressly stated by us in the Lifetime Guarantee or the Silver Jewellery Warranty, all products and services delivered to you through the service are provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied.

To the fullest extent permitted by law, Thésaurí, its directors, officers, employees, affiliates, agents, contractors, suppliers or licensors shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind—including but not limited to loss of profits, revenue, savings, or replacement costs—arising from your use of the Website or any Product, even if advised of the possibility. Where certain jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law. Thésaurí shall only be liable for damages resulting from wilful misconduct or fraud.

SECTION 18 – DEFECTS AND WARRANTIES

The statutory warranty period, as established by applicable law, applies in full. This warranty shall not apply if the defect was known to the customer at the time of purchase.

18.1 Lifetime Guarantee (Stainless Steel) All jewellery from the MUSE and CHEVALIER collections is covered by our Lifetime Guarantee.

Coverage: We will provide a replacement if your stainless steel jewellery tarnishes, fades, loses its colour, or breaks during normal, intended use .
Remedy: We offer one (1) free replacement per item. If the same jewellery is no longer available, you will receive a refund or store credit. After the first replacement, any further approved claims for the same jewellery will be resolved exclusively with a refund or store credit.
Exclusions: The guarantee does not cover lost or stolen items; intentional damage or damage caused by third parties; damage caused by misuse, including exposure to harsh chemicals or excessive force; or surface scratches, dents, bending, or other cosmetic or shape changes resulting from wear or external impact . Any modifications, repairs, or alterations made by third parties void this guarantee.

18.2 Silver Jewellery Warranty (Pre-2026) Silver jewellery from collections released prior to 2026 is covered by a two (2) year warranty from the date of purchase. This warranty applies strictly to manufacturing defects only.

18.3 Warranty Claim Procedure To submit a claim, please email jewellery@thesauri.eu with a clear photo showing the issue and your order or receipt number as proof of purchase . We will provide further instructions within two (2) business days.

SECTION 19 – DELIVERY

19.1 Shipping Methods and Costs We offer free worldwide shipping on all orders.

European Union, United Kingdom, & United States of America: Shipping is conducted via DHL Express and is fully tracked.
Other Regions: Shipping is conducted via Slovak Post with limited tracking.

19.2 Import Duties and Taxes

European Union: Orders are processed as local shipping; no additional taxes or customs duties apply.
United Kingdom & United States of America: Orders are shipped under DDP (Delivered Duties Paid) terms. All applicable import duties and taxes are prepaid by the Company and included in the product price.
Other Regions: Orders are shipped under DAP (Delivered At Place) terms. The recipient is responsible for any import duties, taxes, or local charges imposed by their jurisdiction.

19.3 Timelines and Tracking

Processing: Orders for in-stock items are typically processed within two to three (2-3) business days. During high demand, preparation may require an additional two to three (2-3) business days.
Pre-orders: Pre-ordered jewellery is typically produced and shipped within six to eight (6-8) weeks .
Estimated Delivery: European Union, United Kingdom, & United States of America (2-5 business days); Other Regions (10-21 business days) .
Customers will receive tracking information via email upon dispatch.

19.4 Delivery Obligations

The risk of loss or damage transfers to you upon delivery. You are responsible for:

Providing accurate shipping information; the Company is not liable for losses resulting from incorrect customer-provided information.
Being available to receive shipments or arranging for receipt.
Inspecting the parcel and contents upon delivery and reporting any issues promptly.

If delivery fails due to your unavailability or refusal to accept a shipment, any associated return costs and administrative fees will be deducted from your refund.

SECTION 20 – RIGHT OF WITHDRAWAL AND 30-DAY RETURN POLICY

Consumers are entitled to a statutory right of withdrawal, which Thésaurí has extended to a thirty (30) calendar day return policy to ensure customer satisfaction.

20.1 Return Requirements

To qualify for a return and subsequent refund, the following conditions must be met:

The return must be initiated within thirty (30) days of the delivery date.
The Product must be in its original, unworn condition.
The Product must be returned in its original box.
The customer must provide the order or receipt number as proof of purchase.

20.2 Return Procedure

Notification: Email a return request to jewellery@thesauri.eu including your order or receipt number.
Processing: Allow the Company two (2) business days to process the request and provide specific shipping instructions via email.
Shipping: The customer is responsible for the cost of the return shipping label.

20.3 Refunds Once the return is received and inspected, a refund will be issued to the original payment method within fourteen (14) business days.

20.4 Exclusions

Customised or personalised products are non-returnable.
Items that are lost, stolen, or intentionally damaged are exempt from the return policy.

SECTION 21 – INDEMNIFICATION

You agree to indemnify, defend and hold harmless Thésaurí and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 22 – SEVERABILITY

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 23 – NO WAIVER AND ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms and any policies or operating rules posted by us on this Site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms). Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

SECTION 24 – GOVERNING LAW AND JURISDICTION

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Slovak Republic. The United Nations Convention on Contracts for the International Sale of Goods shall not apply. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts in Bratislava, Slovakia.

SECTION 25 – ALTERNATIVE DISPUTE RESOLUTION FOR CONSUMERS

If you are a consumer and are not satisfied with the way we have handled your complaint, you may contact us for remedy at jewellery@thesauri.eu.

If your request is rejected or not answered within 30 days, you have the right to submit a proposal for alternative dispute resolution (ADR) to the Slovak Trade Inspection (SOI) or another relevant ADR entity. You may also use the European Commission's online dispute resolution platform (ODR) at: https://ec.europa.eu/odr.

SECTION 25A – INFORMATION FOR UNITED STATES CUSTOMERS

Shipping: We ship to all US states via DHL Express. Typical delivery time is 2–5 business days.
Taxes and Duties: No customs or duties apply to United States orders. All orders are shipped under DDP (Delivered Duties Paid) terms; therefore, all applicable import duties and taxes are prepaid by the Company and included in the final product price.
Customer Service: Our team is available via email at jewellery@thesauri.eu. We typically provide a response or instructions within two (2) business days.
State-Specific Rights: Some states provide additional consumer protection rights. These Terms do not limit any rights you may have under your state's specific consumer protection laws.
